Guarantee and Replacement Policy on Un-delivered Items

    Booklets won from kitabel’s eBay auctions, or purchased from Victory Library, are promptly mailed to the purchaser through the United States Postal Service, using the method specified on the auction page or your order form. I notify every purchaser of receipt of payment and mailing by e-mail. However, if your e-mail service rejects this message as spam, or if you don’t read it, I cannot notify you. Requests for “status”, “tracking number”, etc. will not be answered - I don't have that information.
    Civil law considers the Postal Service to be infallible - if it was mailed, it was delivered; almost no mail is “lost”. The total number of items that I have mailed by this method is almost 3000, and only 7 have not been delivered (1/5 of 1%). However, I’m afraid there is no practical way to track the progress through the mail system, as registration, certification or insurance of these items all require that I personally visit the Post Office and wait on line to conduct a separate transaction for each item. The volume sold makes this impossible, and would make the price of the items much higher; please do not request this service.
    My responsibility is limited to delivering the item to the Postal authorities. If this is not acceptable, please do not bid or order.
    The most frequent reason for lack of prompt delivery is delivery to one of the following categories:
  1.  Foreign country. This may take up to 60 days from the date of mailing. Please do not contact me with a request for a duplicate until at least 30 days have passed since you were notified of mailing. Please contact your local Postal authorities regarding delays or failures to deliver mail before contacting me.
  2.  Apartment building. The item is frequently either delivered to the wrong apartment, or mistaken by the management for advertising and discarded.
  3.  Business or professional office. The item is frequently “borrowed” by another employee or visitor.
    Delivery to a private residence is more than 99.9% reliable. In all cases where a reasonable time has elapsed, and it appears that the item has not been delivered, my responsibility is limited to the following terms. If they are not acceptable, please do not bid or order.
    Replacement of un-delivered booklets is limited to the following terms, which the purchaser accepts without condition or exception:
  1.  The booklet is not “lost” until 30 days after mailing. No replacement will be sent until 30 days has elapsed.
  2.  Only a single replacement copy will be supplied - if it is “lost” again, your local service or address is the problem, which is beyond my control.
  3.  The purchaser pays the postage on the replacement copy.
Insurance
    Certain parts which must be mailed in person may be insured. The cost of the insurance will be added to the postage cost. A tracking number is assigned to all insured mail, but the Post Office will not track mail sooner than 15 days from the mailing date, so no request for status can be met until that date. The Post Office will not accept a refund request for the insured value of a lost package until 30 days from the mailing date.
    If your package is lost, which has not happened in over 20 years, your claim is against the Post Office for the insurance, not against me for a refund. I agree only to act as your agent in submitting the insurance receipt for processing, and returning the insured amount to you when the Post Office has paid me.
